Opt-Out Statement Policy
Whether an opt-out statement is required depends on the nature of your broadcast. Commercial and marketing messages must include one; most transactional communications are exempt.
Does This Apply to Me?
Commercial & marketing broadcasts — opt-out required
If you are sending promotional or marketing material — media releases, advertising, offers, newsletters, or any message whose primary purpose is commercial — you must include a clear opt-out statement under the Spam Act 2003 and as a condition of using WEL services.
Transactional broadcasts — generally exempt
Messages sent as part of an existing relationship or service obligation are generally not required to carry an opt-out statement. Examples include:
- Medical records, referrals and clinical correspondence
- Invoices, statements and receipts
- Appointment reminders and booking confirmations
- Legal notices and court documents
- Order or dispatch confirmations
- Security alerts and account notifications
Required Opt-Out Statement (marketing broadcasts)
For commercial broadcasts, include a clear opt-out statement on the first page, such as:
“If you do not wish to receive future communications from the sender, please contact us by the fax, phone or email address provided in this document.”
Your Obligations When a Recipient Opts Out
- Honour the request promptly and notify WEL so the contact can be blocked from future broadcasts.
- WEL maintains an opt-out list that is automatically applied to all future broadcasts from your account.
- Continued sending to opted-out recipients may result in restrictions on your WEL account and exposure under the Privacy Act 1988 and Spam Act 2003.
To add contacts to your opt-out list, go to My Lists › Optout List in the left-hand menu of your account.
